1. Acceptance of these terms
By creating a FamCard account, you agree to these Terms & Conditions and to our Privacy Policy. If you don't agree, please don't use FamCard.
2. What FamCard is
FamCard is a ledger, not a bank. It lets family members who share a credit card log spends against it and record repayments back to the card's owner. FamCard:
- never moves money on your behalf, and has no access to your bank account or card issuer;
- never stores your full card number, CVV, or expiry date — only a nickname and the last 4 digits;
- is not a financial institution, is not licensed to provide banking or payment services, and does not provide financial, tax, or legal advice.
All money movement described in the app (a "repayment") happens outside FamCard — by UPI, EFT, bank transfer, cash, or whatever method your family actually uses. FamCard's role is to help you keep an accurate, shared record of it.
3. Who can use FamCard
You must be at least 18 years old and able to enter into a binding agreement to create a FamCard account and agree to these Terms on your own behalf. FamCard's parental control features (spend limits and approval-required spending) are specifically designed for an adult family member to supervise a minor's spending on a shared card — a minor may hold their own FamCard account only as part of a family set up by, and under the ongoing supervision of, a parent or legal guardian who has agreed to these Terms and remains responsible for that minor's use of FamCard. Every person whose spends or repayments are tracked in a family's ledger needs their own FamCard account — the app does not support recording activity for someone who hasn't signed up.
4. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately if you believe your account has been accessed without your permission.
5. Acceptable use
You agree not to:
- use FamCard for any unlawful purpose, or to defraud any family member or third party;
- attempt to access another user's account or another family's data without authorization;
- interfere with or disrupt FamCard's infrastructure, or attempt to reverse-engineer parts of the service that aren't open for that purpose;
- upload content (including receipt photos or notes) that is unlawful, abusive, or infringes someone else's rights.
6. Disputes between family members
FamCard records what family members tell it — it does not verify spends, adjudicate disagreements, or guarantee that a repayment actually happened outside the app. If family members disagree about a balance, that's a dispute between them; FamCard provides the record (including the built-in dispute/confirm flow for spends and repayments), but is not responsible for resolving disagreements about real-world money.
7. Pricing and plans
FamCard is currently free for families of up to 2 members. Paid tiers for larger families are planned but not yet available; if and when they launch, pricing and billing terms will be presented separately before you're charged anything.
8. Suspension and termination
You can delete your own account at any time from Settings in the app (see our Privacy Policy §8 for what that does). We may suspend or ban an account that violates section 5 of these terms, or that we reasonably believe poses a risk to other users or to FamCard itself.
9. Limitation of liability
FamCard is provided "as is". To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the service, including any financial loss arising from a disagreement between family members about a spend or repayment recorded in the app. Nothing in these terms limits liability that cannot legally be excluded in your jurisdiction.
10. Governing law
This section is a placeholder pending real legal review. FamCard operates across India, South Africa, and Nigeria, and the right choice of governing law and forum for a service spanning three legal systems needs deliberate legal input, not a default assumption. Until that review is complete, these terms are intended to be read alongside — not instead of — any mandatory consumer-protection rights you have under the law of the country you live in.
11. Changes to these terms
We may update these terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where required by law, notify you directly.
